The Balanggarra Aboriginal Corporation RNTBC administers land on behalf of the Balanggarra People. Their native title rights and interests were first recognised in the Balanggarra (Combined) and Balanggarra #3 native title determinations of 2013.

Balanggarra (Combined) concerned recognition of the Balanggarra people’s native title rights and interest over approximately 26,025 square kilometres of land and sea in the northern Kimberley region of Western Australia.

Two native title applications, originally filed in 1995, were amended and combined in 1999 to form Balanggarra (Combined). The claim area included the Kalumburu, Oombulgurri and Forrest River Aboriginal reserves, Carson River pastoral lease, parts of the Drysdale River National Park and unallocated crown land at Cape Londonderry, Carson River and the Cambridge Gulf coast. The northern boundary runs through sea country and encompasses a number of islands near the coast, including the Sir Graham Moore Islands, Adolphus Island and Reveley Island. The respondents to Balanggarra (Combined) were the State Of Western Australia, the Commonwealth, Paspaley Pearling Company Pty Ltd, Roebuck Pearl Producers Pty Ltd and Telstra Corporation Limited.

Balanggarra #3 concerned the recognition of the Balanggarra people’s native title rights and interests over approximately 4,318 square kilometres of land and waters, including areas of the Cambridge Gulf and islands located in the northern Kimberley region of Western Australia. The claim area for Balanggarra #3 included two major land areas: an eastern component, which includes Wyndham, and a western component, which includes parts of Home Valley pastoral station. The eastern and western components of Cheinmora #3 are separated by the southern portion of Balanggarra (Combined). The respondents to Balanggarra #3 were the State Of Western Australia, the Commonwealth, Delaware North El Questro Pty Ltd and Telstra Corporation Limited.

The parties in both matters reached agreement in relation to only part of the land and waters over which the Balanggarra people sought recognition of native title. The parties agreed that no determination would be made over the remaining area where no agreement had been reached and that those areas would continue in case management.

For the areas subject to the parties’ agreement, in both matters, the Court recognised that the Balanggarra people had exclusive native title rights, except where those rights had been extinguished. Acts of extinguishment included some 393 grants of estate in fee simple at Wyndham Port.

The Arabana Aboriginal Corporation RNTBC administers land and waters on behalf of the Arabana People. The Arabana People’s ownership was recognised in the Dodd v State of South Australia determination. The Consent Determination concerned the Native Title Determination Application filed by the applicants on 16 January 1998. The Consent Determination recognises native title rights and interests over an area located in the central north of South Australia, covering approximately 68, 823 square kilometres. The area encompasses Marree in the southeast, Oodnadatta in the northwest, and Lake Eyre and the Wabma Kadarbu Monnd Springs Conservation Park.

The nature and extent of the native title rights and interests existing in the balance of the determination area are as follows:

  • to access and move about the Determination Area;
  • to live, to camp and, for the purpose of exercising their native title rights and interests, to erect shelters and other structures on the Determination Area;
  • to hunt and fish;
  • to gather and use the natural resources of the Determination Area such as food, medicinal plants, wild tobacco, timber, resin, ochre and feathers, but excluding those resources which are specifically excluded, referred to below;
  • to share and exchange the subsistence and other traditional resources;
  • to use the natural water resources of the Determination Area;
  • to cook on the Determination Area and to light fires for domestic purposes but not for the clearance of vegetation;
  • to engage and participate in cultural activities including those relating to births and deaths;
  • to conduct ceremonies and hold meetings;
  • to teach the physical and spiritual attributes of locations and sites within the Determination Area;
  • to visit, maintain and protect sites and places of cultural and religious significance to Native Title Holders under their traditional laws and customs on the Determination Area

In addition, two ILUAs (Indigenous Land Use Agreements) have purportedly been negotiated as part of the mediation process: Notice of application to register on the Register of Indigenous Land Use Agreements

The Antakirinja Matu – Yankunytjatjara claim was first lodged on 14 November 1995 in relation to lands and waters in northern South Australia. The native title claim was resolved the 11 May 2011 at a Federal Court Hearing in Coober Pedy, Justice John Mansfield made a consent determination recognising the Antakirinja Matu – Yankunytjatjara People’s non-exclusive native title rights and interest to that area.

The Antakirinja Matu – Yankunytjatjara Aboriginal Corporation administers land on behalf of the Antakirinja Matu – Yankunytjatjara people, who have been recognised as native title holders of 78,672 sq km of land and waters. The Courts has recognised their non-exclusive rights to hunt, fish, live, camp, gather and use natural resources, undertake cultural activities including relating to births and deaths, conduct ceremonies and meetings, and protect places of cultural and religious significance.

The Alherramp Ilewerr Mamp Arrangkey Tywerl Aboriginal Corporation RNTBC administers land on behalf of the Alherramp/Rrweltyapet, Ilewerr, Mamp/Arrwek, Tywerl, Arrangkey, Anentyerr/Anenkerr and Ntyerlkem/Urapentye Estate Groups. Their native title rights and interests were first recognised in the Napperby Perpetual Pastoral Lease native title determination of 2013.

This matter concerned the first claim over land and waters subject to pastoral leases to the north-west of Alice Springs. The first claim was made by seven groups over approximately 5,600 square kilometres of land and waters within the Napperby pastoral lease and part of the North-West Stock Route (200 kilometres to the north-west of Alice Springs).

In both cases the parties had reached an agreement on the external boundaries of the determination area in which native title existed and on a number of areas within these boundaries which should be excluded from the claim including roads traversing the land, land held in fee simple, areas the subject of pastoral improvements and public works. The determination areas were both subject to pastoral leases issued within the last 20 years. The Court noted that this was only recent history compared with the claimant’s historical relationship with the land.

The Akwerrperl Aboriginal Corporation RNTBC acts as agent for the native title rights and interests of the Ilkewarn, Atwel/Alkwepetye and Ayampe land holding groups in the Kalkarindji region. The native title rights and interests of these groups were recognised in the Bushy Park determination in 2014. The area of the claim is approximately 2,625km2.

On 30 March 2009, Justice Mansfield made two consent determinations recognising the rights and interests of the Adnyamathanha People covering 41,085sq km of land in and around the Flinders Ranges. The determinations give the Adnyamathanha People non-exclusive rights including access for ceremonial or cultural activities, hunting and camping. The determinations also resolve a claim over the 918sq km Flinders Ranges National Park and another claim including 367sq km Angepena pastoral lease. An Indigenous land use agreement (ILUA) for the co-management of the Flinders Ranges National Park has also been finalised. The agreement reflects the Vulkathunha-Gammon Ranges National Park agreement, registered in 2006.

This is the fourth native title determination in South Australia, following De Rose Hill in 2005, Yankunytjatjara/Antakirinja in 2006 and Witjira National Park in 2008.

The Abm Elgoring Ambung Aboriginal Corporation RNTBC acts as an agent for the native title rights and interests of the Kowanyama People in south-west Cape York. The native title rights and interests of the Kowanyama people were recognised in Kowanyama People determination in 2009. In 2012, the Kowanyama people had two more native title claims recognised in Kowanyama People #2 and Kowanyama People #3. The combined area of all three claims is approximately 19,800 square kilometres. 

The name ‘Kowanyama’ means ‘the place of many waters’ and the area includes the Mitchell River System which has a tidal ecosystem where seasonal watering occurs over 40km. The significant wetlands area continues to be used and monitored and managed by the traditional owners. 

The Abm Elgoring Ambung PBC runs Kowanyama camping and rents out four camping grounds on their traditional country to tourists in the area.
